A communication dated 28th August, 2025 by the General Manager's Office, Engineering Department, Jabalpur addressed to the Group General Manager (Inspection) Rites Ltd. for conducting joint inspection with the firm for the warrantee rejection claim has been placed before the Court by the learned advocate representing the petitioners.

Rites have been requested to depute its representative for the inspection. The name of the inspector and the date of joint inspection against the locations mentioned in the annexure to the said communication have been requested to be intimated to the Railway Authority.

From the aforesaid it appears that the Railways have agreed to cause any inspection of the goods supplied by the petitioners which were found to be defective. 4.

It will be open for the petitioners to take part in the process of inspection and point out necessary facts. 5.

If the claim of the petitioners that the goods were defect-free appears to be proper, then necessary remedial steps shall be taken by the Railways.

Steps shall be taken for inspection at the earliest but positively within a period of eight weeks from the date of communication of this order.

Deduction of money from the account of the petitioners, if any, shall be subject to the fate of the inspection.

The writ petition stands disposed of.

It is made clear that the Court has not entered into the issue of maintainability of the writ petition. 10.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
