For the petitioner Mr. Saibal Acharyya Mr. Bibekananda Tripathi ... for the State The petitioner is aggrieved by the fact that the private respondents are encroaching a portion of the property for renting out the telecom company without taking the consent of the co-sharers and, in spite of reporting the incident, the police authorities are inactive.

To that effect, the petitioner filed an application under Section 144 of the Cr.P.C.

I find that such proceeding was filed in the year 2023, and, in between,

substantial time has passed, thus the proceedings basically has become infructuous.

In view of the report which reflects that a proceeding under Section 107 Cr.P.C. has been drawn up by the learned Executive Magistrate, I direct the police authorities to ensure that no breach of peace and tranquility takes place at the locale and also to put in all efforts to see that no untoward incident takes place as the petitioner and the private respondents are at loggerhead in respect of the property.

With the aforesaid observations, WPA 9394 of 2024 is disposed of.
