Petitioner's father served as a cashier in Khejuri College and he died in harness in the year, 2020. An application was made on behalf of the petitioner on June 6, 2020, for his compassionate appointment. It was not considered by the relevant authorities. Against the inaction on the part of the authorities in not giving a compassionate appointment to the petitioner, he filed a writ application being no. WPA 8352 of 2020 before this Court. The said petition was disposed of on January 10, 2022, by a Coordinate Bench, giving a direction upon the Director of Public Instruction, Education Directorate, West Bengal to dispose of the representation of the petitioner within a period of six weeks from date by way of a reasoned order upon hearing of all parties including the petitioner.
It has been submitted by the learned advocate for the petitioner that in terms of the order dated January 10,
2020, the Director of Public Instruction heard all concerned and concluded the hearing on February 22, 2022.
It has further been submitted by the learned advocate for the petitioner that death cum retiral benefits of the deceased father of the petitioner have not yet been released.
Learned advocate appearing for the College submits that the papers relating to provident fund and retiral dues have already been forwarded to the Director of Public Instruction, Government of West Bengal.
In view of the aforesaid, this writ petition being W.P.A. No.8300 of 2022 is disposed of with a direction upon the Director of Public Instruction to communicate the decision with regard to the compassionate appointment of the petitioner within a period of one month from date of communication of this order. The Director of Public Instruction will also ensure that death cum retiral benefits of the deceased father of the petitioner including the pension are released within a period of one month from date of communication of this order.
W.P.A. No.8300 of 2022 is accordingly, disposed of. Let urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
