Petitioner is presently working as primary teacher in a school in Paschim Medinipur and has applied for transfer on the ground of distance in between the present school of the petitioner and her place of residence. It is also stated in the transfer application dated 27th August, 2024 that petitioner is surplus teacher in the primary school where she is working at present. However, the learned advocate has submitted that formal application has not been made to the Chairman, District Primary School Council, Paschim
Medinipur seeking transfer though transfer application was made to the concerned SubInspector of Schools, Vidyasagar Circle. District Primary School Council, Paschim Medinipur and State respondents are represented by learned advocates.
Since petitioner has made an application for transfer from one school to another in same district, Chairman, District Primary School Council, Paschim Medinipur is required to take the decision provided the transfer application is made to that extent.
Leave is granted to the petitioner to make an application seeking transfer to the Chairman, District Primary School Council, Paschim Medinipur being respondent no. 6 by fortnight from date. If such application is made within the aforesaid time respondent no. 6 shall decide the same in accordance with law within a period of 8 (eight) weeks thereafter. Decision to be taken by the respondent no. 6 shall be communicated to the petitioner by fortnight thereafter.
It is made clear that suspension of portal shall not be ground to reject transfer application of the petitioner.
Writ petition stands disposed of.
Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
