The petitioner's application for transfer on medical ground has been returned because she has not completed 5 years in the Uttarpara Girls'High School. The petitioner has joined the school on transfer only a year ago.

The ground of rejection of the application is not sustainable in law. The petitioner's application shall be processed by the head of the institution in terms of the 2015 Rules and appropriate opinion should be sought from the BMOH as regards the petitioner's medical condition.

The petitioner may apply afresh for the aforesaid purpose.

The head of the institution shall take immediate steps within the time frame stipulated under the 2015 Rules to comply with the procedure for seeking medical opinion and take further steps in terms there of. With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.
