Learned counsel for the petitioner contends that the petitioner is financially constrained and is an agriculturist by occupation.

It is submitted that the petitioner has already given a representation to the West Bengal State Electricity Distribution Company Limited (in short 'WBSEDCL'), which is annexed at page 10 of the instant application, for withdrawal of a case of theft registered against the petitioner.

Learned counsel for the WBSEDCL points out that such act of theft has virtually been admitted by the petitioner in the representation itself. That apart, it is submitted on behalf of the WBSEDCL that there are huge arrears due in respect of payment regarding the electric connections-in-question.

However, since learned counsel for the petitioner restricts the prayer of the petitioner to a consideration of

the representation at page 10 of the writ petition, there is no necessity for this Court, particularly in the writ jurisdiction, to go into the merits of the respective contentions of the parties.

Accordingly, WPA 9821 of 2021 is disposed of by directing the respondent no. 3 to consider the representation of the petitioner, annexed as Annexure P1 at page 10 of the writ petition, and decide the same in accordance with law.

The respondent no. 3 shall complete such exercise within a fortnight from date and communicate the decision to the petitioner immediately thereafter. (Sabyasachi Bhattacharyya, J.)
