The petitioner complains that information was furnished with the police authorities on 31.03.2025 specifically accusing the private respondents named therein who has assaulted the petitioner, throttled her and to that effect, petitioner also enclosed medical certificate. Medical certificate complained of physical assault by punching and also throttling the petitioner and it is also found on investigation by the doctor that there is superficial abrasion in front of the neck. Prima facie, there is a corroboration to the complaint. To that effect, learned advocate for the State submitted a report for which Non-FIR PR No. 950/2025 dated

21.04.2025 was registered under Sections 115(2)/351(2) of BNS.

In view of the nature of the offence being noncognizable, police authorities would seek permission under Section 174 of BNSS for registration of the FIR under the same section and proceed with the investigation of the case.

With the aforesaid observations, the writ petition being WPA 8661 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
