23-08-2021 (ct. no.32) debajyoti CRM 3399 of 2021 In re: An application for bail under Section 439 of the Code of Criminal Procedure in connection with Krishnagar Kotwali Police Station Case No.587 of 2020 dated 1708-2020 under Sections 376/326B/120B of the Indian Penal Code.

- A n d - In the matter of : Laxmi Hari .... Petitioner.

Mr. Prabir Majumder ... For the Petitioner.

Mr. Prasun Kumar Dutta, Mr. Pradipta Kumar Ganguly ... For the State.

The petitioner is one of several accused persons. The charge is under Sections 376/326B/120B of the Indian Penal Code.

The case of the State is that the petitioner called the victim to her house. The victim went there, the petitioner and her nephew threw acid on the victim.

We have seen the statements of witnesses recorded under Sections 164/161 of the Code of Criminal Procedure including the statement of the victim. We have seen the injury report as well. The victim girl suffered serious injury. The petitioner says that she has been in custody for about 176 days. Charge-sheet has been filed. Her further detention shall be of no use.

Having considered the material on record and the nature and gravity of the alleged offence, although chargesheet has been filed, we are not inclined to entertain the petitioner's prayer for bail at this stage.

The application for bail being CRM 3399 of 2021 is, thus, dismissed.

All parties shall act on the server copies of this order duly downloaded from the official website of this Court. ( Suvra Ghosh, J. ) ( Arijit Banerjee, J. )
