Kausik (Allowed) CRM (NDPS) 726 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Hastings PS Case No. 86 of 2022 dated 03.07.2022 under Sections 20(b)(ii)(c)/29 of NDPS Act.

Petitioner was arrested on 03.07.2022 and since then he is in custody. The subject matter of the case is alleged recovery of 105.760 Kgs. of Ganja. It has been pointed out that, out of 7 witnesses cited by the prosecution, 3 witnesses have been examined. P.W. 4 appeared but examination-in-chief is deferred.

Learned advocate for the State opposes the prayer for bail.

Having considered that the petitioner is in custody for 3 years and 9 months and some more time will be consumed to take the trial to its logical conclusion, without entering into the merits of the case and only on the ground of period of detention

of the present petitioner, I am inclined to release the petitioner on bail.

Accordingly, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Sanjib Kumar Singh shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, City Sessions Court, Kolkata.

If on bail, petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of the limits of Kolkata Municipal Corporation without the prior permission of the learned Trial Court.

Accordingly, CRM (NDPS) 726 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
