Datta, Mr. Dipankar Das Gupta ...for the State Mr. Pulak Ranjan Mandal, Mrs. Bandana Mandal, Mr. Subhrangsu Panda ...for WBCSC It is the allegation of the writ petitioner that respondent no. 8, on the basis of an ingenuine Scheduled Tribe Certificate, has secured his position as an Assistant Professor through a selection process conducted by the West Bengal College Service Commission. The petitioner suggests that he ranked immediately after the petitioner in the merit list. Therefore, he should be given appointment by cancelling the appointment of respondent no. 8, if the Scheduled Tribe Certificate of respondent no. 8 is found not to be genuine.
The petitioner has not placed any material before this court or pleaded anything to demonstrate
that the caste certificate of respondent no. 8 is not genuine.
Mr. Pulak Ranjan Mandal, learned advocate appearing for the West Bengal College Service Commission, however, submits that in response to a letter issued by the Backward Class Commission of the State, the College Service Commission has forwarded the Scheduled Tribe Certificate of respondent no. 8 by a letter dated February 8, 2024 and thereafter, the Backward Class Commission has not taken any step.
A copy of the said letter from the West Bengal College Service Commission dated February 8, 2024, has been made over to the learned advocate appearing for the petitioner.
As has been noted above, nothing has been placed before this Court to raise suspicion with regard to the genuineness of the Scheduled Tribe Certificate of respondent no. 8. Therefore, this Court is not inclined to entertain this writ petition.
WPA 9645 of 2024 is accordingly disposed of.
Disposal of the writ petition shall not prevent the petitioner for taking necessary steps to challenge the certificate of respondent no. 8 before the appropriate authority.
