The learned counsel has also produce before us the letter of instruction dated 1st February, 2021 from one Maya Sirkar, Constituted Attorney of Mrinal Kanti Sirkar communicating that the matter before the trial court has been withdrawn and in view thereof the appeal has become infructuous.

In view thereof the appeal stands dismissed for nonprosecution. The original letter of instruction dated 01.02.2021 from Maya Sirkar representing herself as Constituted Attorney is kept with the record.
