Report submitted by the State is taken on record. It is submitted on behalf of the petitioner that 4.955 kg. of codeine mixture was allegedly recovered from the possession of the petitioner and the petitioner is in custody for about eight months and though chare-sheet submitted in this case on February 28, 2025, but charge has not yet been framed and nobody knows when the trial would be concluded and as such he may be released on bail on the touchstone of Article 21 of the Constitution of India.

Learned counsel appearing on behalf of the State opposed the bail prayer contending that huge amount of narcotic substance was recovered from the exclusive possession of the present petitioner and it was seized on preparation of proper seizure list and after making video graph properly. The trial is about to start and as such he opposed the prayer for bail. Heard learned advocate appearing on behalf of the petitioner and the State. From the materials placed before me and also the materials available in the case diary, I find that the rigour of Section 37 of NDPS Act clearly attracts in this case in respect of the present petition and as such prayer for bail is rejected.

However, the trial court is requested to make every endeavour for expeditious disposal of the trial. CRM (NDPS) 477 of 2025 is disposed of.

Urgent certified copy of this order, duly applied for, be given to the parties upon compliance with all requisite formalities.
