This revisional application has been filed for quashing of criminal proceeding being complaint case No. 18905 of 2013 under Section 420/120B of the Indian Penal Code pending before the learned Chief Metropolitan Magistrate, Kolkata. The facts of the case is that the opposite party No. 1complainant lodged a complaint case under sections 420/120B of the Indian Penal Code against the petitioners and the learned court below issued process against the petitioners. Being aggrieved by and dissatisfied with such proceedings the petitioners have preferred the present revisional application. It appears from the order of the trial court that after examining the complainant under Section 200 of the Code of Criminal Procedure, a direction was made for investigation under Section 202 of the Code of Criminal Procedure.
Upon primary satisfaction on consideration of the enquiry report process under Sections 420/120B of the Indian Penal Code was issued against the petitioners. Further the allegations squarely relates two questions of facts. In view of the above, the proceeding does not call for interference.
thus dismissed.
It is made clear that the observations made above shall not effect the rights and contentions of the parties in the trial. Interim order, if any, stands vacated.
All connected applications stands disposed of. Urgent photostat certified copy of this order, if applied for, be supplied expeditiously after complying with all necessary legal formalities.
