The application for anticipatory bail under Section 438 CrPC has been filed apprehending arrest in connection with Gangarampur P.S. Case No. 339 of 2020 dated 24.09.2020 under Sections 22(c)/23(c)/27A/28/29 of the Narcotic Drugs and Psychotropic substances Act.

Counsel for the petitioner submits that the contraband articles of 300 bottles of 'phensedyl' was recovered from the house of the petitioner, yet the other inhabitants of the house have not been named in the FIR, excepting the petitioner and another person.

This court is of the view that the petitioner has not been able to make out any case for relief under Section 438 CrPC. In those circumstances, the application stands dismissed.
