The dispute pertains to apprehended splitting of load by the CESC Limited upon the petitioner's application for a new electricity connection. It is contended on behalf of the CESC Limited that the petitioner is already enjoying electricity as a co-owner from the meter of another co-owner in the premises and, hence, in the event a new connection is given, there will be splitting of load which may affect the rates of electricity charges in favour of the consumers unduly. Since the dispute is required to be decided under the law by the Grievance Redressal Officer (GRO), WPA 8731 of 2023 is disposed of by granting liberty to the petitioner to approach the concerned GRO with the issues as raised in the present writ petition.

If so referred, the GRO shall decide the same within eight weeks from the date of reference in accordance with law and upon giving opportunity of hearing to all concerned.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
