This revisional application has been filed by the petitioners for quashing of proceeding being G.R.Case No. 2334 dated 26.9.2012 under Section 498A of the Indian Penal Code.
The factual matrix of the case is that one Sabina Yasmin lodged a complaint with the allegation of torture and on such basis Guskura P.S. Case No. 162 of 2012 was registered. Upon completion of investigation, police submitted charge-sheet against the petitioners under Section 498A of the IPC. Being aggrieved by and dissatisfied with such proceeding, the petitioners have preferred the present revisional application. Ms. Baisali Basu, learned advocate appearing for the State files status report. Let it be kept with the record. She submits that on the basis of prima facie materials, chargesheet has been submitted against the petitioners-accused persons and accordingly, the present revisional application should be dismissed.
It appears from the certified copy of the charge-sheet annexed to the revisional application that on the basis of primary materials collected during course of investigation
police agency submitted charge-sheet under Section 498A of the IPC against the petitioners.
In view of such materials, the proceedings before the trial court does not call for any interference. It is made clear that the above observation shall not have any bearing with the rights and contentions of the parties in the trial court.
The revisional application is dismissed.
All connected applications stand disposed of. Interim order, if any, stands vacated.
