The petitioners allege illegal and unauthorized construction at the behest of the private respondents.

It appears from the submission made on behalf of the petitioner and the State respondents that the issue of unauthorized construction is under active consideration of Tamralipta Municipality in term of the order dated 5th April, 2022 passed by a Co-ordinate Bench of this Court in W.P.A 5917 of 2022 (Sri Ram Gopal Parwal Vs. The State of West Bengal & Ors. ).

Attention of the Court has been drawn to another order passed by a Co-ordinate Bench of the Court in W.P.A 7473 of 2022 (Sri Ram Gopal Parwal Vs. The State of West Bengal & Ors.).

As it appears that the issue is pending consideration before the Tamralipta Municipality,

accordingly, the municipality shall decide the issue in accordance with the direction passed by the Hon'ble Court in the earlier occasions.

No further order is required to be passed in the present writ petition.

The same stands disposed of.

Affidavit-in-opposition and the report filed by the Tamluk Police Station be retained with the record.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
