Bhowmick ...for the respondent Nos. 1 and 2 The petitioner was working with the respondent No. 1/the State Fisheries Development Corporation Limited (SFDCL) as a daily rated worker. The petitioner met with an accident on August 23, 2022 and thereafter was hospitalised. Hence the petitioner could not continue with his regular duties, the petitioner made a representation on September 26, 2022 and intimated the Managing Director, SFDCL about his accident.

Thereafter, the petitioner was declared 'fit' by the concerned medical authority. The petitioner prayed for resumption of his duties by a representation dated December 9, 2022.

It is the grievance of the petitioner that till date the petitioner has not been re-engaged and has not been allowed to resume his duties.

Considering the submissions of the parties and the materials placed, this Court directs the representation of the petitioner dated December 9, 2022 to be considered and disposed of within eight weeks from date by the respondent No. 2/the Projectin-charge, SFDCL or any other authority delegated by him upon giving a personal hearing to the petitioner. A reasoned order shall be passed and communicated to the petitioner within two weeks of passing thereof. With the directions aforesaid, WPA 8736 of 2023 is disposed of.

Since affidavits have not been invited in the present writ petition, the allegations made in the writ petition are deemed not to have been admitted by the parties.
