Khan, learned counsel appearing for the State files an affidavit pursuant to our direction dated 5th August, 2022 sworn in by one Nayan Chakraborty, Officer-inCharge, Baduria Police Station in the District of North 24Parganas stating therein that the sole appellant in the case namely Bablu Mallick @ Md. Bablu Mallick has expired on 15th April, 2015 at R. G. Kar Medical College & Hospital during his incarceration in Dum Dum Central Correctional Home. The corresponding Death Certificate along with disposal order accompanying corpse sent for cremation or burial with the certificate of Sudhansu Mondal Councillor, Ward No. - 16, Baduria Municipality have been annexed to the affidavit. Office No near relative having come forward to continue the appeal on behalf of the appellant within thirty days of the death, the appeal abates on death of the sole appellant.
