None appears for the Panchayat despite service. The petitioners allege that the private respondent encroached upon plot no.614 in Mouja Rameswarbati JL no.182, Police Station Dhaniakhali in raising construction in their plot no.613 which is adjacent to plot no.614. The dispute between the parties is essentially civil in nature. The petitioners are at liberty to approach the appropriate civil forum for redressal of their grievance. The writ petition is not maintainable and is accordingly dismissed.

There shall, however, be no order as to costs. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
