The instant criminal revisional application is pending since 2011 and as such, required to be disposed of. None appears for the parties.

The instant revisional application has been filed for quashing of the complaint giving rise to Ratua Police Station Case No.36 of 2011 dated 15th February, 2011 under Section 4D of the West Bengal Land Reforms Act, 1955 giving rise to G.R. Case No.469 of 2011.

The petitioner contended that the ownership of the disputed land belonged to a person called Mojammel (Daler) who had no right, title and interest over the said land. The allegation against the petitioner is of alteration of the land and deviation in the mode and manner of use of such land in question.

Perused the complaint whereby no specific overt act has been attributed to the present petitioner to have taken effective steps in alteration or illegal conversion as alleged. Under such circumstances, the instant criminal revisional application being CRR 1327 of 2011 is allowed and the proceedings, as aforesaid, is quashed.

Copy of the order be sent to the trial court for immediate compliance.
