Bose ..........for the State The instant criminal revisional application has been filed praying for quashing of the criminal proceeding of Contai PS case no. 263 of 2005 dated 23.12.2005 under sections 363, 366, 109 of the IPC in connection with GR case no. 637 of 2005 pending before the learned Additional Chief Judicial Magistrate, Contai, Purba Medinipur, presently the case is pending before the Civil Judge (Senior Division), 1st Court, Contai, Purba Medinipur.

The complaint, inter alia, stated that the daughter of the complainant being a minor aged about 13 years was induced by the petitioner alluring her to see a movie. Thereafter, on 19.12.2005 at about 10/10.30 a.m. the minor daughter was kidnapped with the aid of his associates with the intention to marry her.

There are sufficient materials in the case diary including the statement of the victim girl recorded under section 164 Cr.P.C against the petitioner, for facing trial. The revisional application is, accordingly, dismissed.

The copy of this order be communicated to the learned trial court for expeditious hearing as the next date for framing of charge has been fixed on 21st July, 2023. ( Ananya Bandyopadhyay,J. )
