Mr. Prantick Ghosh Mr. Siddhartha Sarkar Mr. Hirak Roy .... for the petitioner Mr. Anirban roy Mr. Raja Saha Mr. Debasish Ghosh ..... for the State The only prayer of the petitioner is for consideration of a representation dated 22.02.2022 in relation to an application for Foreign Liquor On Shop. The documents indicate that the enquiry was completed by the Superintendent of Excise on 04.12.2013 followed by a direction on the Collector of Excise to send a report on the construction which was completed by the petitioner as per the blue print. Learned counsel appearing for the petitioner submits that nothing was done thereafter and the petitioner was hence constrained to make the representation in February, 2022. The reasons for the delay in filing the writ petition has been explained in paragraph 5 of the writ petition.

The respondents are represented.

Counsel submits that representation may be considered within a fixed time frame.

After hearing learned counsel appearing for the parties, WPA 8347 of 2022 is disposed of with a direction on the respondent No. 4, being the Collector of Excise, North Parganas, to dispose of the representation at Annexure P4 of the writ petition within a period of three weeks from date. Since the authorities have done nothing since 2013 and 2015, the representation shall be disposed of by way of a reasoned order after hearing all concerned parties including the petitioner. A copy of the reasoned order shall be made available to the petitioner within three days from the date on which such reasoned order is passed.
