Commercial quantity of contraband article was recovered from the joint possession of the petitioner and other co-accused. In view of the statutory restrictions under Section 37 of the NDPS Act, we are not inclined in granting bail to the petitioner.

It is submitted on behalf of the petitioner that the petitioner is in custody for more than seven years. The State vehemently opposes the prayer for bail and refers to material in the Case Diary.

In view of the protracted detention of the petitioner, we request the learned trial Court to expedite the trial of the case as far as the business of the court may permit and to conclude the trial preferably within a period of one year from date.

The application for bail being CRM 3421 of 2021 is, thus, dismissed.
