Purnima Das Mahanta (Biswas) v. N.R Sekar Raju
66-67 27.01.2022 TN CPAN No.393 of 2020 IA No: CAN 1 of 2020 (Old No: CAN 5205 of 2020) In WPA No.16452 of 2019 Purnima Das Mahanta (Biswas) Vs.
Sri N.R. Sekar Raju (Via Video Conference) Mr. Surya Prasad Chattopadhyay, Mr. Arjun Samanta .... for the petitioner Mr. Sahasrangshu Bhattacharyya, Mr. Anuran Samanta .... for the alleged contemnor When the matter is called on for hearing, learned counsel for the petitioner, in his usual fairness, submits that the arrears of pension of the petitioner has been cleared in the meantime by the respondent-authority/alleged contemnor.
It is submitted that the pension may hereafter be regularly given to the petitioner.
The exercise of good office by learned counsel appearing for the alleged contemnor is appreciated. Since the grievance of the petitioner has been
substantially resolved, there is no logic in further keeping the contempt proceeding pending.
Accordingly, CPAN No.393 of 2020 along with CAN 1 of 2020 (Old No: CAN 5205 of 2020) stand disposed of, upon compliance by the alleged contemnor of the order under contempt.
Needless to say, it is expected that the alleged contemnor shall continue to disburse the pension regularly hereafter in favour of the petitioner. There will be no order as to costs.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
