Afajuddin Mandal v. State Of West Bengal
28.04.2025 Court No.28 Item No.43 ssi CRM (A) 1332 of 2025 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Suraksha Nagarik Sanhita in connection with Pukhuria PS Case No.502 of dated 02.09.2024 under Sections 126(2)/115(2)/117(2)/118(2)/109/3(5) of the BNS, 2023. And In the matter of: Afajuddin Mandal ....Applicant/Petitioner.
Mr. Arup Kumar Bhowmick ...for the petitioner.
Mr. Bidyut Kumar Roy Ms. Snigdha Saha ..for the State Learned counsel appearing on behalf of the petitioner submits as follows. There is a dispute between two families. A civil suit is pending. The petitioner obtained an injunction. There are cases and counter cases started by both the sides. In the instant case, one person was granted anticipatory bail and the others are on bail.
Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He relies on the injury report and the statements of the injured witnesses and as well as other eyewitnesses. It appears that one of the victims received a serious injury on his leg and the other victim, a lady, received temporary bone depression and fracture on her head. Several persons were injured.
Considering the nature of injuries inflicted and the incriminating materials available in the case diary against the
accused including the petitioner, I am not inclined to grant anticipatory bail to the petitioner.
Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
