The petitioner is in custody for 1 year and prays for bail. Learned counsel for the petitioner submits that only one witness has named the petitioner to have assaulted the victim with a wicket. The case has not been committed to the learned Sessions Court. His further detention is not required. The petitioner prays for bail.

Learned counsel for the State opposes the prayer. It appears that the petitioner is a part of a group who assaulted the victim resulting in his death. The petitioner was seen to have assaulted the victim resulting in his death, with wicket. The post mortem report indicates that the victim succumbed to the injuries sustained by him.

Considering the nature and gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.

The application for bail is disposed of.
