Heard learned counsels for the parties.

The petitioner is in custody for more than a year and prays for bail on the ground that he is a septuagenarian person and is not a public servant. He is a pygmy agent of Canara Bank, Burrabazar Branch and was responsible for collecting money from customers of the bank on a daily basis. He appointed two persons to collect the said amounts from the customers on his behalf. Trial is in progress and the petitioner shall participate in trial.

Opposing the prayer, learned counsel for the State submits that huge amount of money has been collected by the petitioner and his agents and was not deposited with the bank, thereby resulting in financial loss of lakhs of rupees to the customers.

Learned counsel submits that 7 more witnesses are remaining to be examined and the prosecution shall

conclude examination of witnesses within six months from date.

Considering the nature of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.

The application for bail is thus disposed of. Case diary be returned.
