It is also submitted that, earlier, argument of the case commenced when prosecution filed an application under Section 311 of the Cr.P.C. and recalled P.W.4. However, till date, the evidence of the said witness is not over, although, seven schedules have been fixed. Learned advocate for the State opposes the prayer for bail as 1.4 kg of heroin was seized.

Having considered the stage of the case, I am not inclined to enlarge the petitioner on bail.

Hence, the prayer for bail of the petitioner is Rejected.

However, having considered the stage of the case, I direct the learned trial court that the witness on recall be completed by 15th June, 2026, thereafter, if no defence witness is tendered, pronounce the verdict within 45 days thereof.

Accordingly, CRM (NDPS) 770 of 2026 is dismissed. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
