Mr. Snehansu Majumder ....for the petitioner Mr. Sumanta Das Mr. Suman Biswas ...for the de facto complainant Mr. Anand Keshri Mr. Arup Sarkar ..for the State Learned counsel appearing on behalf of the petitioner submits that a 13 years old girl eloped with the principal accused aged about 23 years as there was a love affair between the two. Learned counsel appearing on behalf of the de facto complainant, after obtaining instructions from the victim, strongly opposes the prayer for bail and denies any relationship with the petitioner. She supports the prosecution case. Learned counsel appearing on behalf of the State relies on the materials available in the case diary including the statements of the minor victim recorded before the learned Magistrate. Considering the incriminating materials available in the case diary including the statement of the minor victim, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail to the petitioner is rejected.
