A direction to secure expeditious disposal of an injunction application in connection with Title Suit No. 871 of 2019 pending before the leaned Civil Judge (Senior Division), 1st Court, Barasat, is the ultimate prayer in this case.

Mr. Subhendu Banerjee, learned advocate for the petitioner/defendant submits that petitioner has been suffering ad interim order of injunction. It is further contended that unless injunction application is disposed of in an expeditious manner, there will be a serious prejudice caused to petitioner/defendant.

No other point is raised requiring address by this Court.

In view of the nature of the order proposed to be made in this case, no prior notice is considered to be necessary upon the opposite party.

Service of notice of this application upon opposite party stands dispensed with.

Accordingly, learned Civil Judge (Senior Division), 1st Court at Barasat in Title Suit No. 871 of

2019 is directed to ensure expeditious disposal of the pending suit, referred hereinabove, after causing disposal of injunction application, but without granting unnecessary adjournments, unless it is extremely unavoidable.

Petitioner is directed to make communication of this order to the learned advocate for the opposite party as well as learned court below.

With this observation and direction, the revisional application stands disposed of.

After causing disposal of injunction application, this would not, however ,prevent the Court below from ensuring expeditious disposal of the suit in accordance with the provisions of the law.

Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
