This is an application for a direction upon the trial Court for expeditious disposal of NDPS Case No. 107 of 2019 corresponding to Sessions Trial No.07(01) of 2022 under Section
20 (b)(ii) (c)/29 of Narcotic Drugs and Psychotropic Substances Act, 1985.
It is submitted on behalf of the petitioner that the petitioner was arrested on 15th December, 2019 in connection with Entally P.S. Case No.387 dated 15th December, 2019 on the allegation that he was illegally possessing narcotic substance above the commercial quantity.
After completion of investigation police submitted charge sheet against the petitioner on 6th July, 2020. The trial Court framed charge against the accused on 20th January, 2022 and took up the case for trial. Out of 13 charge sheeted witnesses till date only three witnesses were examined by the prosecution.
During trial it is the duty of the prosecution to produce the witnesses. The learned trial Judge is directed to take stern action against the prosecution if the prosecution fails to produce witnesses on the date of trial. He is also directed to fix a schedule for examination of the remaining witnesses without fixing a singular date for examination of one witness and thereafter fix another date after a lapse of quite some months. The learned trial Judge is directed to conclude the examination of all the witnesses within six months from the date
of communication of this order and come to a logical conclusion of the case within one month thereafter.
With the above direction, the instant revision is disposed of.
The petitioner is at liberty to act on the server copy of this order.
