For the Petitioners Mr. Goutam Banerjee, Advocate ... ...For the State CRM (A) 1560 of 2023 is disposed of as infructuous on behalf of the petitioner no. 2 (Sourav Sk) since he was arrested. It is submitted on behalf of the petitioners that the present police case is on the basis of the same incident which is the subject matter of a previous police complaint where the petitioner no. 1 is on bail.

Considering the materials in the case diary and the involvement of the petitioner no. 1 as appearing from the materials in the case diary, we are inclined to grant anticipatory bail to the petitioner no. 1 (Fultura Bibi @ Fulsura Bibi). Accordingly, we direct that in the event of arrest the petitioner no. 1 (Fultura Bibi @ Fulsura Bibi) shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand Only), with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that the

petitioner no. 1 shall cooperate with the investigations till its conclusion and on further condition that the petitioner shall appear on every date before the jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioner in Court including cancelling the anticipatory bail granted without further reference to this Court. Prayers for anticipatory bail of the petitioners are partly allowed.

CRM (A) 1560 of 2023 is disposed of.
