16.07.2021 Item no.26 Court No.30 Avijit Mitra CRM No.5783 of 2020 (Through Video Conference) with CRAN 2 of 2020 In Re:
An application for relaxation of conditions of anticipatory bail.
And In re: Ajoy Dalsingh & anr.
... petitioners.
Mr. Soumyajit Das Mahapatra ... for the petitioner.
Mr. Swapan Banerjee, Ms. Purnima Ghosh ... for the State.
The present application has been preferred, inter alia, praying for relaxation of the conditions of bail, as incorporated in the order dated 3rd September, 2020 passed in CRM No.5783 of 2020.
Mr. Das Mahapatra, learned advocate appearing for the petitioners submits that the petitioners have complied with the conditions as incorporated in the order dated 3rd September, 2020 till date. No such conditions were imposed in respect of the other co-accused persons. In the said conspectus, he prays for relaxation of the conditions of bail. Learned advocate appearing for the State has placed before us a report as regards compliance of the conditions of bail. A perusal of the same reveals that the petitioners and other co-accused persons entered the district of Jhargram and even threatened the complainant and, accordingly, prosecution under Section 107 of the Code of Criminal
Procedure was initiated. Let a copy of the said report, as produced, be kept on record.
Upon hearing the learned advocates appearing for the respective parties and considering the report, we are not inclined to relax the conditions of bail as incorporated in the order dated 3rd September, 2020 passed in CRM No.5783 of 2020.
The application being CRAN No.2 of 2020, accordingly, is dismissed.
All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
