Kahar Molla @ Mollah v. State Of West Bengal
14.05.2025 Ct.No.34 b.das Rejected C.R.M. (M) 242 of 2025 In Re : An application for bail under Section 483 of BNSS, 2023 filed in connection with Kasba Police Station Case No.162 of 2021 dated 19.06.2021 under Section 307 of the Indian Penal Code.
And In Re : Kahar Molla @ Mollah ... Petitioner.
Mr. Deepak Prahladka Ms. Reshmi Khatun ... for the petitioner.
Ms. Saila Afrin Ms. Debadrita Mondal ... for the State.
Heard learned counsels for the parties.
The petitioner is in custody for more than 3 years and prays for bail solely on the ground of his prolonged detention.
Learned counsel for the State opposes the prayer. I have considered the material on record. Allegation against the petitioner is extremely serious in nature. Injuries sustained by the victim are very grave. Delay in progress of trial can be attributed to the petitioner as well as prosecution and the petitioner cannot seek bail on the ground of slow progress in trial. The prosecution proposes to examine 17 witnesses out of whom 5 witnesses are already examined.
Considering the nature and gravity of the offence as well as prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.
The application for bail is thus disposed of. Case diary be returned.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
