Mr. Rajib Ghosh ... for the petitioner At the time of call Mr. Ghosh, learned advocate representing the petitioner has prayed for accommodation. However, on perusal of records it appears that the petitioner has made a statement in paragraph 2 of the writ petition that he was appointed as Muharrir Grade-I in Higher Education Department, Government of West Bengal.

Considering such statement made in paragraph 2 it appears that petitioner is a Government employee and not an employee of Government aided educational institutions.

In view of aforesaid position, the writ petition is not maintainable and accordingly the same stands dismissed.

However, dismissal of this writ petition shall not preclude the writ petitioner to approach before the appropriate forum in accordance with law for redressal of his grievances.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
