Parveen ... for the Petitioner(s) Mr. Bibaswan Bhattacharya Mr. Akash Ganguly ... for the State-respondent(s) Learned advocate for the petitioner submits that the subject-matter of the case relates to alleged recovery of 1 kg 187 gm of brown sugar and so far as the present petitioner is concerned, he has been implicated on the basis of statement of a co-accused. According to the petitioner, the petitioner is innocent of the charges and charge-sheet has already been submitted before the learned jurisdictional court, as such, he prays that the petitioner may be released on bail.

Learned advocate for the State, on the other hand, opposes the prayer for bail and on a query from this court, learned advocate submits that there are no CDR and/or money trail so far as the present petitioner is concerned.

However, so far as the other accused persons are concerned, there are CDR and/or money trial.

Having regard to the fact that that the only material which is available against the present petitioner is the statement of the co-accused, I am of the view that further incarceration of the present petitioner is unwarranted. Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Sayed Mia @ Sayed Sk shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned Judge, Special Court-cum-Addl. Dist. Judge, 4th Court, Malda.

If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special Court/trial court and shall not leave the district of Malda without prior intimation to the learned Special Court/trial court.

Accordingly, CRM (NDPS) 732 of 2026 is allowed. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
