Jagannath Roy & ors Ms. Anyasha Das ...for the petitioners A direction to secure expeditious disposal of an Eviction Suit being Title Suit No.412 of 2014, pending before the learned Civil Judge (Junior Division), 1st Court, Barasat, is the ultimate relief sought for in this case.

Learned advocate for the petitioners/landlords submits that till date application under Section 7(2) of the W.B.P.T. Act has not yet been disposed of resulting in serious prejudice to the petitioners/landlords.. The only contention expressed by the learned advocate for the petitioners is against the delay caused in the disposal of the appeal.

In view of the nature of order proposed to be made in this case, no prior notice is considered to be necessary.

Service upon the opposite parties stands dispensed with.

Since petition under Section 7(2) of the W.B.P.T. Act has not yet been disposed of , that should be disposed of expeditiously.

Accordingly, learned Civil Judge (Junior Division), 1st Court, at Barasat, in Title Suit No.412 of 2014, is requested to ensure expeditious disposal of petition under Section 7(2) of the W.B.P.T. Act, providing sufficient opportunity of hearing to either of the parties to this case, but without granting any unnecessary adjournment, unless it is extremely unavoidable. Petitioners are directed to make communication of this order to the learned court below as well as to the opposite parties and their learned advocate appearing in the court below.

With this observation/direction, the revisional application stands disposed of.

Urgent certified photostat copy of this order, if applied for, be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Subhasis Dasgupta, J.)
