And In the matter of:- Ranjit Kumar Dutta ... Petitioner Mr. Malay Bhattacharya, Mr. Subir Sabud, Mr. Subhrojyoti Ghosh .. for the petitioner Mr. Prasum Kr. Datta, Ld. A.P.P., Mr. Nirupam Dhali ..for the State The petitioner undertakes to affirm and stamp the petition/application as per Rules within a month of resumption of normal functioning of the Court. Subject to such undertaking, the application is taken up for hearing through video conference Learned advocate for the petitioner draws the attention of this Court to the order dated 19.08.2020 passed by a coordinate Bench of this Court. Learned advocate further submits that pursuant to such order deposits have been made with the affected

parties to that effect. Learned advocate produces the money receipt on a stamp paper signed by one Sabyasachi Das. We have perused the copy of the same and directed a photostat copy to be kept with the record.

Mr. Datta, learned advocate appearing for the State produces the copy of the compliance report so submitted by the Investigating Officer of the case. The said report reflects that the sum so directed to be deposited has already been deposited and accepted by the complainant.

Let the report be kept with the record.

Having taken into account the changed circumstances, we are of the opinion that the petitioner may be extended the benefit of anticipatory bail.

The prayer for anticipatory bail of the petitioner is allowed. Accordingly, in the event of arrest, the petitioner be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of arresting officer and on condition that he shall not tamper with the evidence or intimidate the witnesses. Further, the petitioner shall make himself available as and when required by the investigating officer of that case. The aforesaid order of anticipatory bail shall be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

With these observations, CRM 5789 of 2020 and CRAN 1 of 2020 (Old No. CRAN 4197 of 2020 are disposed of.

Learned appropriate Trial Court as well as all concerned authorities shall act in terms of the copy of the order downloaded from the official website of this Court.
