In Re : CAN 4 of 2023 Heard Mr. Sau, learned counsel appearing on behalf of the petitioner and Mr. Hussain, learned counsel representing the opposite party.

This is a joint application for compromise.

It is submitted that the parties have settled their dispute out of Court and the terms of settlement has been set out in the application. Pursuant to such compromise the petitioners do not want to proceed with this revisional application on merit. When the parties have settled their dispute and the terms of settlement has set out in the joint application for compromise are found to be lawful, this Court does not find any reason to stand in the way.

The compromise is accepted and the revisional application being C.O. 1386 of 2001 is disposed of in terms of joint application for compromise.

The joint application for compromise being CAN 4 of 2023 do form part of the order.

Pursuant to this order the order passed by the learned Civil Judge (Junior Division), 1st Court, Malda is set aside. Let a copy of the order be sent down to the learned Trial Court for information and necessary action.
