Petitioner has prayed for sanction of family pension being the widow-daughter of a deceased Primary Teacher, who retired on 30th April, 2000. It is submitted that father of the petitioner died on 22nd April, 2013 and he was in receipt of pension. Subsequently, mother was also receiving family pension, who died on 20th July, July, 2024. According to the petitioner, after death of mother she, being widow-daughter, is entitled to receive family pension.

However, on perusal of legal heir certificate dated 12th December, 2024, it appears same has not been issued by the competent authority.

Leave is granted to the petitioner to obtain legal heir certificate from competent authority. After obtaining legal heir certificate petitioner shall be at liberty to approach the concerned respondent authorities for grant of family pension.

With the above observations, writ petition stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
