...for the State By consent of the parties, the matter is taken up for consideration as an "Application".

This application is filed for modification of the order dated 6th July, 2021. In view of the fact that while considering the matter, the learned Chairman of the West Bengal Administrative Tribunal in the order dated 23rd July, 2021 observed that the matter on merit cannot be taken up for consideration as a previous order was passed by the Division Bench of the West Bengal Administrative Tribunal.

In view of Section 5(6) of the Administrative Tribunal Act, 1985, we request the learned Chairman of the West Bengal Administrative Tribunal to hear CCP 12 of 2021 (OA No. 224 of 2019) and MA 26 of 2021 (OA 224 of 2019) on 18th August,

2021 without granting any adjournment to either of the parties unless there are unavoidable circumstances.

The learned Chairman is also requested to dispose of the main matter on merits on that date if possible or any other suitable date convenient to the learned Chairman. This application is accordingly, disposed of. However, there shall be no order as to costs.
