Report submitted by the State be kept with the record. In spite of service being effected none appears on behalf of the private opposite party.
Learned advocate appearing for the petitioners submit that petitioners are in custody for eight months and the evidence of the victim and some of the vulnerable witnesses are over. Learned advocate for the petitioners drew the attention of the Court to the deposition of the victim.
Learned advocate appearing for the State opposes the prayer for bail and draws the attention to the statement under Section 164 of Cr.P.C.
I have taken into account the deposition of the victim. Having regard to the totality of the circumstances, particularly, the locus of the two petitioners in respect of the complicity as described by the victim, I am of the view that the prayer for bail of petitioner no.1, namely, Lalon Mondal @ Lalon Islam be rejected, while the prayer for bail of petitioner no.2 namely, Milon Mondal @ Mandal be allowed.
As such, the petitioner no.2 namely, Milon Mondal @ Mandal shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court, Lalbagh, Murshidabad.
If on bail, the petitioner no.2 shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of district of Murshidabad without prior permission of the learned Special Court.
Thus, CRM (M) No. 957 of 2026 is partly allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
