No. 29 CHC Rejected C.R.M.(A) 1321 of 2024 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Hili Police Station Case No. 41 of 2024 dated 06.03.2024 under Sections 21(c)/22(c)/23(c)/27A of the Narcotic Drugs and Psychotropic Substances Act, 1985.

And In the matter of : Firdus Mandal @ Mithun Mondal @ Firoz Mondal ...... petitioner Ms. Busra Khatoon ....for the petitioner Mr. Shekhar Barman ....for the State Petitioner prays for anticipatory bail.

There are two police cases as against the petitioner, one involving inter alia Arms Act and other the NDPS Act, 1985. So far as the N.D.P.S. Case is concerned, charge-sheet was submitted by the police.

In view of the criminal antecedents of the petitioner, we are unable to hold that, the petitioner is unable to overcome the restrictions under Section 37 of the N.D.P.S. Act, 1985. Consequently, we are unable to grant anticipatory bail to the petitioner.

This application for anticipatory bail is, thus, rejected. Signed By :
