Party/Parties is/are represented in the order of their name/names as printed above in the cause title. This appeal is against the Order passed by the Hon'ble Single Judge in WP No. 13264(W) of 2018 dated 18th September, 2018 wherein the Hon'ble Single Judge has directed the Collector, Purba Burdwan to determine the rent compensation in respect of the aforesaid erstwhile requisitioned plots from the date of publication of notice under Section 3(1) of Act II of 1948 till the acquisition of the aforesaid plots is made under the Act of 2013. During the pendency of this appeal, by an Order dated 25th April, 2022, the Principal Secretary, Finance Department was added as a Party
Respondent to the instant appeal and the Principal Secretary, Finance Department was directed to address the issues and to file a Report before this Court with regard to the disbursement of the amount of Rs.86,28,379.00/- in favour of the Landlosers/the writ petitioners.
In compliance with the Order (supra) passed by this Court, the Principal Secretary, Finance Department had appeared before this Court in person and submitted that he has complied with the order. Today, Learned Counsel for the appellants has submitted a Compliance Report wherefrom it reveals that the amount has been released by the appellants in favour of the Landlosers/the writ petitioners. Learned Counsel for the writ petitioners/Landlosers has confirmed that the Landlosers/the writ petitioners have received the said amount.
Since the appellants have complied with the Order passed by the Hon'ble Single Judge by releasing the total amount in favour of the writ petitioners/Landlosers as directed by the Hon'ble Single Judge and Learned Counsel for the Landlosers/the writ petitioners submits that they have received the total amount as full and final settlement and no further claim remains with the appellants herein. In view of the above, no further
order is required to be passed in the instant appeal. In the light of the above discussions, MAT 522 of 2019 along with CAN 1 of 2020 (Old No. CAN 2030 of 2020) and CAN 2 of 2020 (Old No. CAN 2031 of 2020) stand accordingly disposed of.
Compliance Report (supra) as filed by Learned Counsel for the appellants be retained with the record.
