Kausik (Allowed) CRM (NDPS) 734 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kumarganj Police Station Case No. 252 of 2024 dated 28.08.2024 under Sections 21(c)/22(c)/23(c)/27A of the NDPS Act, 1985.

Learned advocate appearing for the petitioners submits that he is in custody for more than 2 months and has been implicated on the basis of statement of co-accused. Similarly placed accused person has been granted bail.

Learned advocate for the State opposes the prayer for bail.

I have taken into account the quantum of seizure in the present case which is of 200 bottles of Phensedyl and 200 bottles of Phensegrip. Having considered the fact that similarly placed accused persons have been granted bail in CRM (NDPS) 257 of 2026, I direct the learned Special Court to release the

petitioners on bail on same terms and conditions as was imposed upon Bipul Mulla @ Bipul Molla, the other accused person.

Accordingly, CRM (NDPS) 734 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
