Ct. No.23 CRM 5823 of 2020 CRAN 4237 of 2020 (via video conference) In re:- An application for bail under Section 439 of the Code of Criminal Procedure, 1973.

In re: Laltu Singh & Anr.

.......Petitioners Mr. Siddhartha Sarkar.

......for the petitioners.

Mr. Ranabir Roychowdhury, Mr. Mainak Gupta.

.......for the State.

Learned advocate for the petitioners submits that the accused persons are in custody for over 332 days and that they have been falsely implicated in this case. He also submits that if the post-mortem report which has been produced before this Court in terms of the order dated 4th September, 2020, no external injury over the body of the victim would be seen.

Mr. Roychowdhury, learned advocate for the State produced the case diary before this Court which reflects the non-availability of the clinical report. After perusal of the case diary and the materials on record particularly the independent witnesses alleging torture against the victim both at the instance of the petitioner no.1 husband and the

petitioner no.2 mother in law and corroboration of the statements of witnesses in the post-mortem report, we are not inclined to allow petitioners' prayer for bail at this stage. The application for bail is rejected. CRM 5823 of 2020 and CRAN 4237 of 2020 are rejected and disposed of.
