Case No.321 of 2026 dated 06.04.2026 under Sections 126(2)/117(2)/109/351(2)/3(5) of the BNS, 2023.

And In the matter of: Paritosh Mondal and others ... petitioners Mr. Sumanta Das ... for the petitioners Ms. Shaila Afrin Ms. Rituparna Saha ... for the State Learned counsel for the petitioners submits that there was a fight between neighbours which resulted in injuries to both sides.

Learned counsel for the State opposes the prayer for anticipatory bail and refers to the injury report of the aged victim lady. She submits that the injury was inflicted on a vital part of the body, like the head, which required five stitches for repair. She also refers to the statements of witnesses including that of the victim.

Considering the above, the other materials available in the case diary and the alleged role ascribed to each of the present petitioners, while I am inclined to grant anticipatory bail to the petitioner Nos.1 and 3, the application for

anticipatory bail of the petitioner No.2 (Swarna Mondal) is rejected.

In the event of arrest, the petitioner Nos.1 and 3 (Paritosh Mondal and Parimal Mondal) shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further conditions that the petitioner Nos.1 and 3 shall cooperate with the investigation, shall meet the investigating officer once a week till submission of report in final form and shall not threaten or intimidate witnesses. The application for anticipatory bail is, thus, disposed of.
