Heard learned counsel for the parties.

The grievance of the petitioner is that the private respondent is seeking to take electricity connection to his property over the property of the petitioner, taking undue advantage of an order dated February 20, 2023 passed in WPA No.

1131 of 2023.

Learned counsel appearing for the West Bengal State Electricity Distribution Company Limited (WBSEDCL) submits that, as yet, no

police costs have been deposited by the private respondents, for which the order could not be given effect to.

Be that as it may, it transpires that vide order dated February 20, 2023, a direction had been given to the WBSEDCL simpliciter to give electricity connection to the petitioner at the earliest.

However, there is no specification in the said order as to the route over which such connection is to be given to the petitioner therein, that is, the private respondent.

Hence, the present writ petition is rather premature in the sense that no electricity connection has yet been given by the WBSEDCL to the private respondent herein.

However, needless to say, in the event the present petitioner is aggrieved by the route over which such connection is given to the private respondent in compliance of the order dated February 20, 2023, it will always be open to the present petitioner to approach the concerned District Magistrate with such dispute.

If such dispute is referred, the said Magistrate shall decide the same in accordance with law, upon following due process of law.

Accordingly, WPA No. 8786 of 2023 is disposed of in the light of the above direction. There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
