CRR 1182 of 2021 (Through Video Conference) In Re: An Application Article 227 of the Constitution of India. In the matter of: Smt. Kasturi Gangopadhyay Mr. Sanjib Mitra, For the petitioner Mr. Sanjib Mitra, learned advocate appearing for the petitioner, submits that an application was filed by the petitioner before the learned Magistrate under Section 21 of the Protection of Women from Domestic Violence Act, 2005, wherein the petitioner has prayed for custody of his minor child.

In the pandemic situation, it is not possible for the learned Magistrate in the Court below to decide the application at a normal pace.

However, in view of the innocuous nature of the prayer made by the learned advocate for the petitioner, this application is disposed of by giving direction upon the learned Judicial Magistrate, 5th Court, Alipore, to dispose of the application under Section 21 of the Protection of Women from Domestic Violence Act, 2005, being A.C. Case no. 4028 of 2019, as early as possible preferably, within a period of three months from the date of the resumption of the normal functioning of the Court.
